1. ACCEPTANCE OF TERMS

These Terms of Service (“Terms”) govern your access to and use of the Hit It Longer website located at https://hititlonger.com, our online golf instruction and membership services, digital content, courses, lessons, programs, communications, and related features (collectively, the “Services”). Hit It Longer (“Company,” “we,” “us,” or “our”) provides the Services.

By accessing the Website, creating an account, purchasing a membership, purchasing an additional product or service, enrolling in a course or program, or otherwise using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, you must not access or use the Services.

These Terms apply to both free and paid users, including members of our Silver Membership, VIP Membership, and any future membership, course, product, or service offered through the Website.

2. ELIGIBILITY AND ACCOUNT REQUIREMENTS

You must provide accurate and complete information when creating an account, purchasing a membership, or purchasing any product or service. You are responsible for maintaining the accuracy of your account information and for keeping your login credentials confidential.

You are responsible for all activity that occurs under your account. You agree to notify us promptly if you believe your account credentials have been compromised or your account has been accessed without authorization.

Unless we expressly permit otherwise, your membership and account are personal to you and may not be sold, transferred, shared, or provided to another person.

3. USE OF THE WEBSITE AND SERVICES

You agree to use the Website and Services only for lawful purposes and in accordance with these Terms.

You may not:

Attempt to gain unauthorized access to the Website, membership area, accounts, systems, or networks;
Interfere with or disrupt the operation, security, or availability of the Services;
Use bots, spiders, scrapers, automated systems, or similar tools to access, copy, monitor, or collect content without our written permission;
Copy, reproduce, distribute, publish, sell, sublicense, or commercially exploit membership content or course materials without written permission;
Share your account credentials or allow another person to access paid membership content through your account;
Attempt to circumvent membership restrictions, access controls, or other security measures; or
Use the Services in a manner that violates applicable law or infringes the rights of another person.

4. GOLF INSTRUCTION AND EDUCATIONAL CONTENT

Hit It Longer provides golf instruction, educational information, demonstrations, drills, training concepts, practice recommendations, and related content for informational and educational purposes.

Golf instruction involves physical activity and carries inherent risks, including the possibility of injury. You are responsible for determining whether a particular exercise, drill, swing change, practice activity, or other instruction is appropriate for you.

You should use appropriate judgment and, when appropriate, consult a qualified medical or fitness professional before beginning physical activity, particularly if you have an injury, medical condition, physical limitation, or other concern.

Our instruction is not medical, physical therapy, or medical treatment advice. We do not diagnose, treat, or prevent medical conditions.

Individual golf performance varies. We do not guarantee any particular improvement in swing mechanics, clubhead speed, distance, accuracy, handicap, scoring, tournament performance, or other golf-related result.

5. MEMBERSHIPS AND DIGITAL CONTENT

Our memberships provide access to digital golf instruction, videos, lessons, training materials, resources, community features, and other content made available as part of the applicable membership.

The specific content, features, benefits, pricing, and availability of a membership are described at the time of purchase and may change from time to time.

Membership access is provided only for the period for which your membership is active and paid, unless we expressly provide otherwise.

We may add, modify, replace, suspend, or discontinue portions of the Services or membership content from time to time. We will use reasonable efforts to maintain the overall membership service, but we do not guarantee that any particular video, lesson, feature, instructor, program, or piece of content will remain available indefinitely.

6. MEMBERSHIP BILLING AND PAYMENT PROCESSING

Paid memberships may be offered on a recurring subscription basis, including monthly memberships such as Silver Membership and VIP Membership. The applicable price and billing frequency will be presented to you before you complete your purchase.

By purchasing a recurring membership, you authorize the applicable payment system to charge your selected payment method for the membership fee on a recurring basis until the membership is canceled or otherwise terminated.

Hit It Longer uses Kajabi as the primary platform for managing membership access, delivering membership content, and facilitating membership subscription and payment processing. Your Kajabi membership transaction is processed through the payment-processing services connected to Kajabi.

Your subscription will generally renew automatically at the applicable recurring rate unless you cancel it before the next scheduled renewal. Cancellation procedures are made available through your account, the applicable Kajabi membership interface, or by contacting us at the support address below.

Unless otherwise stated for a particular offer or required by applicable law, canceling a subscription stops future recurring charges but does not automatically provide a refund for amounts already paid or for unused time remaining in the current billing period.

If a membership payment fails, we or our payment-processing provider may attempt to process the payment again, restrict access to paid content, or suspend or terminate the membership until the account is brought current.

We may change membership pricing for future billing periods. Where required by applicable law, we will provide notice of material price changes before the new price is charged.

7. ADDITIONAL PRODUCTS, UPSELLS, AND PAYMENT PROCESSING

In addition to your Kajabi membership, Hit It Longer may offer additional products, services, training programs, instructional materials, special offers, upgrades, or other purchases (“Additional Products”).

Additional Products are separate from your Kajabi membership and are not necessarily purchased or billed through Kajabi.

Payment forms for Additional Products are provided through GoHighLevel (“GHL”). Each applicable GHL payment form may be used to collect payment information and complete the purchase of the particular Additional Product presented on that form.

Payments submitted through these GHL payment forms are processed using Stripe. Accordingly, Stripe may process your payment information, including payment-card information, in connection with your purchase.

Refunds for Additional Products purchased through a GHL payment form are also processed through the applicable Stripe payment-processing system. Any refund eligibility, amount, and applicable conditions are determined by the refund policy or purchase terms presented for the particular Additional Product, together with applicable law.

Purchasing an Additional Product does not automatically change, cancel, upgrade, downgrade, or otherwise modify your Kajabi membership unless the applicable offer expressly states otherwise.

Likewise, canceling your Kajabi membership does not automatically cancel a separately purchased Additional Product, unless the applicable purchase terms expressly provide for such cancellation.

Because different products may use different payment systems, you should review the purchase page and confirmation associated with each transaction to understand which platform processes that particular payment and what cancellation or refund terms apply.

8. CANCELLATIONS AND REFUNDS

Cancellation and refund terms for a particular membership, course, Additional Product, promotion, or offer may be stated at the time of purchase and will apply to that transaction.

For Kajabi memberships, cancellation generally stops future recurring membership charges but does not automatically result in a refund of the current billing period, unless otherwise stated or required by applicable law.

For Additional Products purchased through a GoHighLevel payment form, refunds are processed through Stripe and are subject to the refund terms presented for that particular purchase, together with applicable law.

Where a refund is approved for an Additional Product, the refund may be returned to the original payment method used for the transaction.

Nothing in these Terms limits any refund, cancellation, or other consumer right that cannot lawfully be waived under applicable law.

9. FREE TRIALS, PROMOTIONS, AND SPECIAL OFFERS

From time to time, we may offer free trials, discounted memberships, promotional pricing, bonuses, coupons, upsells, or other special offers. Additional terms may apply to those offers.

If a free trial or promotional period converts into a paid subscription, the applicable renewal price, billing frequency, and cancellation terms will be disclosed when you enroll, subject to applicable law.

Promotional offers for Additional Products may be presented through GoHighLevel payment forms and may be subject to separate purchase, refund, expiration, or eligibility terms.

We reserve the right to modify or discontinue promotional offers at any time, subject to the terms applicable to an offer you have already accepted.

10. THIRD-PARTY TECHNOLOGY AND SERVICE PROVIDERS

Our Services rely on third-party technology and service providers, including Kajabi, GoHighLevel, and Stripe, to operate portions of our website, membership experience, customer relationship management, payment processing, communications, and marketing activities.

Kajabi is used to deliver membership content, manage member access, and facilitate membership subscriptions and related payment processing.

GoHighLevel is used for certain marketing, customer relationship management, communications, and payment-form functions. Information associated with your membership or purchases may be transmitted to GoHighLevel for these business purposes.

Stripe is used to process payments and, where applicable, refunds for Additional Products purchased through GoHighLevel payment forms.

We do not sell, rent, or otherwise provide your personal information to third parties for their own independent marketing purposes. Information may nevertheless be disclosed to service providers when reasonably necessary for us to operate the Website and Services, process transactions, provide customer support, communicate with you, maintain security, comply with law, or perform other legitimate business functions.

Your use of third-party services may also be subject to the terms and privacy policies of those providers. Our Privacy Policy provides additional information about how we collect, use, and disclose personal information.

11. INTELLECTUAL PROPERTY

All content made available through the Website and Services, including text, videos, photographs, graphics, logos, trademarks, audio, instructional materials, lesson plans, written materials, software, page designs, and other materials, is owned by Hit It Longer or its licensors and is protected by copyright, trademark, and other applicable intellectual property laws.

Your membership gives you a limited, personal, non-exclusive, non-transferable, revocable right to access and use the content for your own personal, non-commercial golf education and development while your membership is active.

You may not, without our prior written permission:

Copy, reproduce, download, record, republish, or redistribute membership content;
Sell, sublicense, lease, or commercially exploit membership content;
Share paid content with non-members;
Upload our content to another website, social media account, file-sharing service, artificial intelligence system, course platform, or other public or private repository;
Create derivative courses, products, training programs, or other commercial materials substantially based on our content; or
Remove copyright, trademark, or other proprietary notices.

12. TRADEMARKS

Hit It Longer, its logos, names, designs, and related marks are trademarks or service marks of Hit It Longer or their respective owners. Nothing in these Terms grants you a license to use any trademark, logo, or other brand element without prior written permission.

13. USER-SUBMITTED CONTENT AND FEEDBACK

If you submit comments, questions, reviews, testimonials, photographs, videos, suggestions, feedback, or other materials to us (“User Content”), you represent that you have the right to submit that material and that doing so does not violate the rights of another person.

By submitting User Content, you grant Hit It Longer a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and distribute that content as reasonably necessary to operate, improve, support, or promote our Services, subject to our Privacy Policy and any separate permission we obtain from you where required.

We may remove User Content that we believe violates these Terms, applicable law, or the rights of others.

14. TESTIMONIALS AND REVIEWS

If you voluntarily provide a testimonial, review, success story, photograph, video, or other promotional material and give us permission to use it for marketing purposes, we may use that material in connection with Hit It Longer and its Services.

We will not represent that you achieved a result that you did not actually report or experience.

15. PROHIBITED CONTENT AND CONDUCT

You may not use the Services to submit, transmit, or distribute content that is illegal, fraudulent, threatening, abusive, defamatory, obscene, infringing, or otherwise harmful.

You may not use the Services to interfere with the rights, privacy, security, or enjoyment of other users.

We reserve the right to remove content, restrict access, suspend accounts, or terminate memberships when we reasonably believe these Terms have been violated or when necessary to protect the Website, our users, or our business.

16. PRIVACY

Your privacy is important to us. Our collection, use, retention, and disclosure of personal information are described in our Privacy Policy.

We do not sell, rent, or trade your personal information. We may share information with service providers that perform services on our behalf, including platforms used to operate our website, deliver membership content, process subscriptions and payments, provide customer support, manage customer relationships, send communications, conduct analytics, maintain security, or perform other necessary business functions.

For membership customers, certain information may be transmitted from Kajabi to GoHighLevel for customer relationship management, marketing, communications, and related business purposes.

For Additional Products purchased through GoHighLevel payment forms, information necessary to complete the transaction may be processed by GoHighLevel and Stripe.

17. COMMUNICATIONS AND MARKETING

When you provide your contact information, you may receive transactional, service-related, educational, or marketing communications from Hit It Longer.

Marketing communications may include information about golf instruction, memberships, products, programs, promotions, events, upsells, or other offerings that may be relevant to you.

You may opt out of promotional email communications by using the unsubscribe mechanism included in the applicable communication. Opting out of marketing communications does not prevent us from sending transactional or service-related communications necessary to administer your account, purchases, or membership.

Where applicable, text-message marketing will be subject to the consent and opt-out terms presented when you subscribe to such messages.

18. CUSTOMER RESPONSIBILITY AND INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Hit It Longer, its owners, employees, contractors, instructors, representatives, affiliates, and service providers from claims, damages, losses, liabilities, costs, and reasonable expenses arising out of or related to your unlawful use of the Services, violation of these Terms, infringement of another person's rights, or User Content you submit.

19. DISCLAIMER OF WARRANTIES

TO THE FULLEST EXTENT PERMITTED BY LAW, THE WEBSITE, MEMBERSHIP PLATFORM, DIGITAL CONTENT, GOLF INSTRUCTION, PRODUCTS, AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

We disclaim warranties including, to the extent permitted by law:

Merchantability;
Fitness for a particular purpose;
Non-infringement;
Accuracy, completeness, or reliability of content;
Availability or uninterrupted operation; and
That errors or defects will be corrected.

We do not guarantee any particular golf result, performance improvement, distance increase, handicap reduction, score improvement, or other outcome from using our instruction or Services.

20. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Hit It Longer and its owners, employees, instructors, contractors, affiliates, agents, licensors, and service providers will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or related to your use of, or inability to use, the Website or Services.

This includes, without limitation, claims involving loss of profits, loss of data, business interruption, service interruptions, technical failures, third-party service failures, payment-processing failures, or other consequential losses.

To the fullest extent permitted by law, our aggregate liability for claims arising out of or relating to a paid Service will not exceed the amount you actually paid to Hit It Longer for that Service during the twelve (12) months immediately preceding the event giving rise to the claim.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.

21. THIRD-PARTY LINKS AND SERVICES

The Website or Services may contain links to third-party websites, products, services, applications, or resources. We provide those links for convenience and do not control or necessarily endorse third-party websites or services.

Your use of third-party websites and services is governed by their own terms and privacy policies. We are not responsible for their availability, content, security, or practices.

22. SERVICE AVAILABILITY AND CHANGES

We may modify, suspend, or discontinue all or part of the Website or Services at any time. We may also update content, features, instructors, programs, technology, or membership benefits from time to time.

We will make reasonable efforts to maintain access to the Services but do not guarantee that the Website or membership platform will always be available, uninterrupted, secure, or error-free.

23. TERMINATION AND SUSPENSION

You may stop using the Services at any time and may cancel a recurring membership according to the applicable cancellation procedure.

We may suspend or terminate your access to the Website or membership Services if you violate these Terms, fail to pay applicable fees, misuse the Services, compromise the security of the Website or other users, or when otherwise reasonably necessary to protect our business or users.

Termination does not eliminate obligations that by their nature should survive termination, including intellectual property rights, disclaimers, limitations of liability, indemnification, dispute provisions, and payment obligations accrued before termination.

24. DISPUTE RESOLUTION AND ARBITRATION

Except where prohibited by applicable law or where a claim qualifies for small claims court, any dispute, claim, or controversy arising out of or relating to these Terms, the Website, or the Services shall be resolved through binding individual arbitration administered by JAMS, or by the American Arbitration Association (“AAA”) if JAMS is unavailable, under the applicable consumer arbitration rules.

To the extent permitted by law, you and Hit It Longer agree that disputes will be handled individually and not as part of a class, collective, or representative action.

To the extent permitted by applicable law, you and Hit It Longer waive the right to a jury trial for disputes subject to arbitration.

Nothing in this section prevents either party from bringing an individual qualifying claim in small claims court or seeking temporary or injunctive relief from a court when permitted by law.

25. GOVERNING LAW

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except to the extent federal law or other applicable law requires otherwise.

26. CHANGES TO THESE TERMS

We may update these Terms from time to time. When we make changes, we may update the “Last Updated” date above and, when appropriate, provide additional notice.

Your continued use of the Website or Services after updated Terms become effective constitutes acceptance of the revised Terms, except where applicable law requires a different form of acceptance.

27. GENERAL PROVISIONS

Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
No Waiver: Our failure to enforce any provision of these Terms does not constitute a waiver of our right to enforce that provision later.
Entire Agreement: These Terms, together with our Privacy Policy and any additional terms expressly incorporated into a particular offer or service, constitute the agreement between you and Hit It Longer concerning your use of the Services.
Assignment: You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, reorganization, sale of assets, or similar business transaction.
Electronic Communications: You agree that electronic communications, notices, disclosures, and agreements may satisfy legal requirements that such communications be in writing, to the extent permitted by law.
